YOUR AFFIRMATIVE ACT OF USING THE WEBSITE SIGNIFIES THAT YOU AGREE TO THE FOLLOWING TERMS OF USE, AND YOU CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF PERSONAL INFORMATION AS DISCLOSED IN THE PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE WEBSITE.

This is a common-law contract between the user and the PMA.

CHANGES TO THE TERMS OF USE The PMA may change these Terms of Use at any time. You can review the most current version of these terms by clicking on the “Terms of Use” link located at the bottom of our web pages. You are responsible for checking these terms periodically for changes. If you continue to use the Website after we post changes to these Terms of Use, you are signifying your acceptance of the new terms.

CHANGES TO THE WEBSITE The PMA may discontinue or change any service or feature on the Website at any time and without notice.

OWNERSHIP OF INFORMATION; LICENSE TO USE THE WEBSITE; REDISTRIBUTION OF DATA Unless otherwise noted, all right, title, and interest in and to the Website, and all information made available through the Website or its Services, in all languages, formats, and media throughout the world, including all copyrights and trademarks therein, are the exclusive property of the PMA, its affiliates, or its assigns. Any Content on the Website that is hosted by the PMA is owned by or licensed to the PMA. Such Content includes data wholly owned by or managed by the PMA. You may not capture, record, publish, display, create derivative works of, or republish the Content owned or hosted by the Website in whole or in part without written consent from the PMA.

In no event shall any user publish, retransmit, redistribute, or otherwise reproduce any Website Content in any format to anyone, and no user shall use any Website Content in or in connection with any business or commercial enterprise without the express written consent of the PMA. You may use the Website and the Content offered on the Website only for personal, non-commercial purposes. You may use Content offered for downloading, such as data files, for personal use only and subject to the rules that accompany that particular Content. You may not use any data mining, robots, or similar data gathering and extraction tools on the Content, frame any portion of the Website or Content, or reproduce, reprint, copy, store, publicly display, broadcast, transmit, modify, translate, port, publish, sublicense, assign, transfer, sell, loan, or otherwise distribute the Content without our prior written consent. You may not circumvent any mechanisms included in the Content for preventing the unauthorized reproduction or distribution of the Content.

By using our platform/service to participate in live sessions/meetings, you acknowledge and agree that any videos recorded during these sessions/meetings may be used for future promotional content, as may be quotations recorded during these sessions. These recordings may be utilized for internal purposes such as quality assurance, training, and archival purposes, as well as for promotional activities. Your continued use of the platform/service constitutes acceptance of this policy regarding the use of recorded videos and your past use assents to continued use of past recordings.

THIRD PARTY SITES AND ADVERTISERS The Website may include links to third-party websites. Some of these sites may contain materials that are objectionable, unlawful, or inaccurate. You agree that the PMA shall not be held liable for any activities that occur on any website you access through links on the Website. We provide these links as a convenience and do not endorse the content or services offered by these other sites. Any dealings that you have with advertisers found on the Website are between you and the advertiser, and you acknowledge and agree that we are not liable for any loss or claim you may have against an advertiser.

If you register as a user (a “Member”) of any of the features of the Website, including newsletters, the PMA will automatically opt you into our email lists. As a Member, the PMA may send you relevant content, some of which may include advertisements for third-party products and services, special offers, webinars, educational materials, and promotions tailored to your perceived interests. From time to time, we may ask Members to review and agree to our Terms and Conditions. Upon your acceptance, you agree to let the PMA add you back to our commercial email lists.

You can edit your Account Information, including your newsletter preferences, at any time. Commercial email communications from the Website come with an unsubscribe link at the bottom for you to opt-out of future such marketing communications. You can also email the PMA at any time and request to be removed, temporarily or permanently, from one or all of our email lists.

DISCLAIMER REGARDING CONTENT The PMA cannot and does not represent or guarantee that any of the information available through the Services or on the Website is accurate, reliable, current, complete, or appropriate for your needs. Due to various factors — including the inherent possibility of human and mechanical error — the accuracy, completeness, timeliness, results obtained from use, and correct sequencing of information available through the Services and Website are not and cannot be guaranteed by the PMA. Neither the PMA nor its affiliates make any express or implied warranties (including, without limitation, any warranty of merchantability or fitness for a particular purpose or use) regarding the Content on the Website. The Website Content is provided to the users “as is.” Neither the PMA nor its affiliates will be liable to any user or anyone else for any interruption, inaccuracy, error, or omission, regardless of cause, in the Website Content or for any damages (whether direct or indirect, consequential, punitive, or exemplary) arising from the use of the Website, Services, or information.

REGISTERED USERS Certain services, such as courses, private access groups, communities, membership areas, or other features, are available only to registered users of the Website and require you to sign in with a username and password to use them. If you register as a user (a “Member”) of any of the features of the Website, during the registration process, you may be prompted to click a “Register Now,” “Submit,” or similar button; your clicking on such button will further confirm your agreement to be legally bound by these Terms and Conditions.

In consideration of your use of the Website, you represent that you are of legal age to form a binding contract. You also agree to: (a) provide true, accurate, current, and complete information about yourself as prompted by the registration form (the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or the PMA has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, the PMA has the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

ACCESS AND SECURITY You accept responsibility for the confidentiality and use of any username and email address that you may register for your access to and use of the Services. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify the PMA of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. The PMA cannot and will not be liable for any loss or damage arising from your failure to comply.

FEEDBACK TO THE PMA By submitting ideas, suggestions, documents, and/or proposals to the PMA through its contact or feedback webpages, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) the PMA is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) the PMA shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) the PMA may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of the PMA without any obligation of the PMA to you; and (f) you are not entitled to any compensation or reimbursement of any kind from the PMA under any circumstances.

INDEMNITY You agree to indemnify and hold the PMA and its subsidiaries, affiliates, officers, agents, employees, partners, and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit, modify, or otherwise make available through the Services, your use of the Services, your connection to the Services, your violation of the Terms of Use, or your violation of any rights of another.

TERMINATION You may terminate your account and access to the Services by submitting such termination request to the PMA. Members can automatically either deactivate or delete their account through the various member pages on the site.

You agree that the PMA may, without prior notice, immediately terminate, limit your access to, or suspend your account and access to the Services. Cause for such termination, limitation of access, or suspension shall include, but not be limited to, (a) breaches or violations of the Terms of Use or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) discontinuance or material modification to the Services (or any part thereof), (d) unexpected technical or security issues or problems, (e) extended periods of inactivity, (f) engagement by you in fraudulent or illegal activities, (g) and/or abusive correspondence with the PMA or potentially slanderous or defamatory statements made to anyone. Further, you agree that all terminations, limitations of access, and suspensions for cause shall be made in the PMA’s sole discretion and that the PMA shall not be liable to you or any third party for any termination of your account or access to the Services.

BILLING, CANCELLATION & REFUND POLICY Unless otherwise stated, all subscriptions are automatically renewing.

To cancel any subscription, please log in to the Website and visit the member pages or send a request to cancel through our Contact Form. Upon receipt and processing of the cancellation request, the PMA will email you a cancellation confirmation. Please retain a copy of the cancellation email for your records.

Annual subscriptions may be eligible for a full refund at any time within the first 7 days of your payment date, subject to terms of any offers. Monthly subscriptions are eligible for a refund within 24 hours of your payment date. Course purchases are non-refundable after 3 days from purchase. After the aforementioned refund periods, all sales are final. To request a refund, follow the steps above to cancel your subscription and when doing so include a request for a refund. Upon receipt and processing of the request, the PMA will acknowledge the cancellation via email and process the request for a refund. If the refund request was sent within the time period allowed, the refund will be approved and processed within 7 business days.

The PMA does not offer partial cancellations. Upon cancellation, your service will remain active through the end of your paid term.

DISPUTES Dispute Resolution Under Common Law The Parties agree that any dispute, controversy, or claim arising out of or relating to this Agreement, including its formation, interpretation, breach, or termination, shall be resolved exclusively according to the principles of common law. The Parties do not consent to statutory jurisdiction or administrative tribunals.

Good Faith Negotiation The Parties agree to first attempt to resolve any disputes through good faith discussions and negotiation. Either Party may initiate this process by providing written notice of the dispute, outlining the nature and basis of the claim.

Private Resolution Forum If the dispute is not resolved within 30 days of notice, the matter shall be submitted to a mutually agreed-upon private third-party mediator or, if necessary, to a private common law tribunal or court of record convened by agreement of the Parties. The forum shall have no ties to statutory courts or government agencies.

Governing Law This Agreement and any disputes arising from it shall be governed by the principles of natural law and common law, including maxims of equity, fairness, and due process, rather than by statutory or commercial codes unless specifically incorporated by written consent of the Parties.

Jurisdiction and Venue The Parties do not consent to jurisdiction under any statutory or corporate court system. Jurisdiction shall lie only in a venue operating in accordance with the original and organic common law of the land.

Waiver of Arbitration and Statutory Courts The Parties expressly waive any right to compel or be compelled into arbitration under statutory law or to bring disputes before any statutory court unless voluntarily consented to in writing after the dispute has arisen.

Remedies and Enforcement Any judgment, finding, or resolution reached through the common law process may be enforced privately by the Parties through contract law and in honor. The Parties agree to be bound by the outcome of the chosen private process.
